Dispute Resolution
1. Commitment to Amicable Resolution
I&C Real Estate Investments is committed to resolving any disputes in a friendly and efficient manner, always maintaining open and transparent communication with our clients. We encourage the resolution of issues or conflicts directly between the parties involved.
2. Mediation
If it is not possible to resolve the dispute amicably, the parties agree to attempt to resolve the conflict through mediation before resorting to the courts. The mediation will be conducted by an independent mediator, chosen by both parties or, in the case of disagreement, by a specialized mediation entity in Cape Verde.
Mediation is a voluntary, swift, and confidential process aimed at achieving a mutually acceptable solution. If mediation does not result in an agreement, the parties may pursue other dispute resolution methods, including arbitration or court proceedings.
3. Arbitration
If the dispute remains unresolved after mediation, the parties agree to submit the conflict to arbitration, conducted in accordance with Cape Verdean law, specifically the Commercial Arbitration Law. The arbitrator’s decision will be binding, and the parties agree to comply with its terms.
The arbitration will be held confidentially, and the process will take place in Nossa Senhora das Dores, Sal Island, unless otherwise agreed by the parties.
4. Judicial Jurisdiction
Should the dispute not be resolved through mediation or arbitration, the parties agree that the competent court will be the judicial district of Nossa Senhora das Dores, Cape Verde, waiving any other jurisdiction that might otherwise apply.
5. Costs
The costs associated with the dispute resolution process (mediation or arbitration) will be borne by the parties as agreed during the process, unless otherwise determined by the mediator or arbitrator.
6. Final Provisions
